The Rye Arts Center Zoning Petition

Rye Arts Center, Inc. has submitted a petition to the Rye City Council to amend the text of the Rye City Zoning Code to permit “Arts Center Use” as a new use permitted subject to additional standards and requirements in the R-1 to RT Residence Districts.

The Rye Arts Center is a not-for-profit corporation that operates under a long-term lease in a City-owned building at 51 Milton Road, located within Rye Recreation Park. Recently, a benefactor acquired an adjacent residential property at 25 Milton Road and gifted the property to the Rye Arts Center

The Rye Arts Center Zoning Petition

Rye Arts Center, Inc. has submitted a petition to the Rye City Council to amend the text of the Rye City Zoning Code to permit “Arts Center Use” as a new use permitted subject to additional standards and requirements in the R-1 to RT Residence Districts.

The Rye Arts Center is a not-for-profit corporation that operates under a long-term lease in a City-owned building at 51 Milton Road, located within Rye Recreation Park. Recently, a benefactor acquired an adjacent residential property at 25 Milton Road and gifted the property to the Rye Arts Center to construct a new art center facility. The petition for amendment to the Rye City Zoning Code is required because the contemplated use for 25 Milton Road for an arts center facility does not fit into any existing use categories in the Rye City Zoning Code in any of the zoning districts.

    I have lived in Rye for 13 years, since my twins were 7 years old. The Rye Arts Center was an integral part of our lives and the shaping of my twins over these years. It is an incredible place with good, thoughtful people working and running it for the betterment of our community.     I have been a Rye resident for 12 years and am a current supporter and board member of The Rye Arts Center (“RAC”). I support the RAC’s proposed zoning amendment at 25 Milton Road. I believe that the new RAC will be of great benefit to all of our community - through improved Arts educational facilities, enhanced cultural offerings (art gallery, music and performing arts spaces), an after-school space for teens, an upgraded maker space and a wonderful outdoor green space (sculpture garden and plein air painting space).

    There is hopefully a time when an organization attains a momentous point in its life that requires either more personnel, more space or both to ensure it can continue to fulfill its mission. RAC is one such organization, requiring more space to support the very community it has served for decades. I applaud that they've arrived at this point and seek to build upon its successful past to accommodate the future.

    Upon our first meeting with RAC they stated that the RAC would be open to all of Westchester and they would bus chidden in for programs. Clearly this impacts traffic and parking in an already congested residential neighborhood but there is a bigger point this highlights and is one brought up in the zoning meeting, That of fiscal survival. It is my understanding that RAC's last budget ran in the red.     While I am fine with the Rye Art Center expanding, and while I understand the property next door into which it plans to expand was donated to the Center to use as it chose, I think the proposed expansion, as we’ve seen in the architectural rendering, will be completely out of place in the surrounding neighborhood. As I think I understand it, the Center already does not conform to the zoning requirements of that area, but more or less grew into its present location without a zoning change really being addressed.     While the Art Centers opportunity to expand is desirable, the current concept is totally out of character for the historic nature of the neighborhood. The initial concept of a modernistic design instead of something that complements the surrounding area is a huge misstep in seeking community support. What's more, proposing a parking lot in the front of the building establishes the Center as a commercial zone, not a residential neighborhood, something they stated they wanted to maintain. Rye's business district and churches typically have parking in the rear maintaining the community’s character and appeal.

    As a neighbor and a mother, I am deeply concerned with the proposal to rezone the residential neighborhood to include a large parking lot in the midst of an already busy intersection. If the Rye City Council Members and the members of the Rye Planning Commission visited the site for the proposed project on a weekday morning or late afternoon, it would become abundantly clear that it is an accident, and likely many accidents, waiting to happen, next door to the nursery school and residential houses with small children.     Unless you regularly cross from 66 Milton Road to the parking lot, you would not have a true understanding of the perils. Cars ignore the crosswalk, lights blinking. They exceed the speed limit. If a car stops, the other behind it just moves to its right, approaching the curb, and swings by, at speed. For a pedestrian, that's a blind spot. And, dangerous.
